Resale & Trademark Policy

In plain English: Fire Kicks buys authentic, brand-name sneakers and streetwear on the open market and resells them. We are not affiliated with any brand. Every item is genuine. We are legally permitted to resell these items under U.S. law.

1. Independent Resale Marketplace

Fire Kicks, LLC ("Fire Kicks," "we," "us," or "our") is an independent resale marketplace. We are not affiliated with, authorized by, endorsed by, or in any way officially connected to Nike, Inc., Jordan Brand, Adidas AG, New Balance Athletics, Inc., Converse Inc., Vans Inc., Puma SE, Reebok International, or any other brand, manufacturer, or trademark owner whose products appear on this site.

All brand names, product names, model names, logos, and trademarks referenced on this website are the property of their respective owners. References to these names and marks are made solely for the purpose of identifying the genuine products being offered for resale and do not imply any affiliation with or endorsement by those trademark owners.

2. First Sale Doctrine

The resale of authentic goods is a federally protected right in the United States. Under the First Sale Doctrine — codified in copyright law at 17 U.S.C. § 109 and recognized under trademark law — the lawful owner of a genuine article bearing a trademark has the right to resell that article without the authorization of the trademark holder.

All items sold through Fire Kicks are authentic goods that were lawfully purchased through authorized retail channels, licensed distributors, or the secondary market from verified sources. Once those goods were lawfully sold for the first time by or with the authorization of the trademark owner, our right to resell them was established.

Fire Kicks does not sell counterfeit, replica, unauthorized reproduction, or grey-market goods. Every item listed on this platform is a genuine product.

3. Trademark Use for Identification Purposes

Where product names, model numbers, colorway names, or brand names appear on this website, they are used exclusively as descriptive identifiers to accurately describe the specific authentic item being offered for sale — for example, "Air Jordan 1 Retro High OG" or "Adidas Yeezy Boost 350 V2."

This use falls within the doctrine of nominative fair use, which permits the use of a trademark to accurately refer to the trademark owner's goods when no other reasonable means of identification exists, and when the use does not suggest affiliation with or sponsorship by the trademark owner.

Fire Kicks makes no claim of ownership over any third-party trademark. We do not use brand logos, distinctive trade dress, or brand imagery as our own. All brand marks remain the sole property of their respective owners.

4. Authentication & Authenticity Guarantee

Every item offered through Fire Kicks is inspected and verified for authenticity by our in-house authentication team before it is listed or shipped. We employ trained authenticators and use industry-standard verification processes to ensure no counterfeit, replica, or unauthorized item is ever sold through our platform.

If a purchased item is found to be inauthentic, buyers are entitled to a full refund under our Buyer Protection policy. We take product integrity seriously and will not compromise on it.

5. No Affiliation or Sponsorship

Fire Kicks is not a licensed retailer, authorized dealer, or official partner of any brand mentioned on this site. We do not represent ourselves as such, and nothing on this site should be construed as implying any official relationship between Fire Kicks and any brand.

Customers should be aware that manufacturer warranties, brand loyalty programs, or other brand-specific benefits may not apply to items purchased through secondary-market resellers including Fire Kicks.

6. Intellectual Property Concerns

If you are a trademark owner or authorized representative and believe that content on this site infringes your intellectual property rights — beyond the lawful resale and identification use described in this policy — please contact us in writing at the address below. We take such concerns seriously and will respond promptly.

Please include: (a) your contact information and proof of authorization; (b) a description of the intellectual property you believe is being infringed; (c) the specific URL(s) on this site where the alleged infringement appears; and (d) a statement explaining why you believe the use is not lawful resale or nominative fair use.

7. DMCA, Copyright & Bad-Faith Takedown Notices

The Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, provides a process for copyright owners to request removal of allegedly infringing content from online platforms. We take valid DMCA notices seriously and will respond promptly.

Important: The DMCA governs copyright, not trademark

The DMCA is a copyright statute. It does not provide a mechanism for trademark owners to compel removal of content. The display of a brand name or product name to accurately describe a genuine item for resale is covered by trademark's nominative fair use doctrine — not copyright law — and cannot be the basis of a valid DMCA takedown notice. Notices asserting DMCA rights over the mere use of a brand name or trademark in a product listing are legally deficient.

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing — including submitting a DMCA notice to a hosting provider in bad faith — is liable for any resulting damages, including attorneys' fees. Fire Kicks reserves the right to pursue all available legal remedies against parties who submit false or abusive takedown notices.

What constitutes a valid DMCA takedown notice (17 U.S.C. § 512(c)(3)):

  • Physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the specific material claimed to be infringing, with sufficient detail to locate it (e.g., a URL)
  • Contact information for the complaining party
  • A good-faith statement that the use is not authorized by the copyright owner, its agent, or law
  • A statement, under penalty of perjury, that the information is accurate and the sender is authorized to act on the copyright owner's behalf

Notices that do not substantially comply with these requirements are legally deficient. Fire Kicks will not act on notices that assert trademark rights through the DMCA mechanism, claim infringement based solely on the identification of authentic goods by their brand name, or fail to identify a specific copyrightable work being infringed.

8. Hosting & AWS Acceptable Use Policy Compliance

This website is hosted on Amazon Web Services (AWS). We fully comply with the AWS Acceptable Use Policy. Our operations do not involve:

  • Any illegal or fraudulent activity
  • Violation of any third party's rights
  • Distribution of counterfeit or unauthorized goods
  • Any activity prohibited under applicable federal, state, or local law

The resale of authentic, lawfully purchased goods is a legal commercial activity expressly protected by the First Sale Doctrine under U.S. law. Our use of brand names to identify authentic products for resale is protected nominative fair use under trademark law and does not constitute infringement of any party's rights.

Complaints submitted to AWS or other hosting providers alleging that our lawful resale activity or our use of brand names to describe authentic products violates the AWS AUP or constitutes infringement are without legal merit. We maintain records of all inventory sourcing and authentication to demonstrate the lawful origin of our inventory at any time.
